Parties to the Petition<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Petitioners:<\/strong> Parents and students directly affected by corporal punishment in schools, acting through their appointed representatives.<\/li>\n\n\n\n<li><strong>Respondents:<\/strong>\n<ol class=\"wp-block-list\">\n<li>The Cabinet Secretary, Ministry of Education.<\/li>\n\n\n\n<li>The Teachers Service Commission (TSC).<\/li>\n\n\n\n<li>[Name of School(s) and\/or Individual Teachers].<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2. Factual Background<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>That the Petitioners are parents and students who have suffered and\/or witnessed corporal punishment inflicted upon children in schools by teachers or administrators.<\/li>\n\n\n\n<li>That despite the <strong>Children Act, 2001 (Section 18)<\/strong> and the <strong>Basic Education Act, 2013<\/strong>, which expressly outlaw corporal punishment, rogue schools and teachers continue to engage in this unlawful practice.<\/li>\n\n\n\n<li>That such acts have resulted in physical injuries, psychological trauma, and violations of the constitutional rights of children.<\/li>\n\n\n\n<li>That parents who raise complaints are often ignored, intimidated, or dismissed by school authorities, thereby denying them effective remedies.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4. Legal Provisions Violated<\/h2>\n\n\n\n<p>The actions and omissions complained of herein violate the following legal provisions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 27 (Equality and freedom from discrimination).<\/strong><\/li>\n\n\n\n<li><strong>Article 28 (Right to human dignity).<\/strong><\/li>\n\n\n\n<li><strong>Article 29 (Freedom and security of the person, including the right not to be subjected to torture or cruel, inhuman or degrading treatment).<\/strong><\/li>\n\n\n\n<li><strong>Article 53 (Rights of children, including the right to free and compulsory basic education and protection from abuse, neglect, harmful cultural practices, and inhuman treatment).<\/strong><\/li>\n\n\n\n<li><strong>Children Act, 2001 \u2013 Section 18 (protection from torture and cruel treatment).<\/strong><\/li>\n\n\n\n<li><strong>Basic Education Act, 2013 \u2013 Section 36 (prohibition of physical punishment).<\/strong><\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5. Grounds of the Petition<\/h2>\n\n\n\n<p>a) That corporal punishment in schools is <strong>illegal and unconstitutional<\/strong>.<br>b) That failure by the Respondents to enforce the law amounts to <strong>dereliction of duty<\/strong>.<br>c) That rogue schools and teachers subjecting children to corporal punishment undermine the <strong>rule of law<\/strong> and <strong>public trust in education<\/strong>.<br>d) That affected students suffer <strong>irreparable harm<\/strong>, both physically and psychologically.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">6. Prayers Sought<\/h2>\n\n\n\n<p>The Petitioners humbly pray for the following reliefs:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>A <strong>declaration<\/strong> that corporal punishment in schools is unconstitutional, illegal, and a violation of children\u2019s rights.<\/li>\n\n\n\n<li>A <strong>mandatory order<\/strong> compelling the Ministry of Education and the Teachers Service Commission to enforce existing laws prohibiting corporal punishment.<\/li>\n\n\n\n<li>A <strong>permanent injunction<\/strong> restraining the named schools, teachers, and administrators from subjecting students to corporal punishment.<\/li>\n\n\n\n<li>An order directing the Respondents to establish <strong>independent reporting and redress mechanisms<\/strong> for parents and students affected by such abuse.<\/li>\n\n\n\n<li>Such further orders as this Honourable Court may deem just and expedient in the interests of justice.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">7.
