Introduction<\/h2>\n\n\n\n<p>Coffee and tea remain Kenya\u2019s most valuable export crops and a source of livelihood for millions of households. Despite their economic and cultural significance, the sectors are plagued by <strong>systemic exploitation, price manipulation, weak governance structures, and limited access to transparent markets<\/strong>.<\/p>\n\n\n\n<p>The <strong>Kenya Association of Intellects (KAI)<\/strong> submits this memorandum to advocate for <strong>urgent legal, regulatory, and policy interventions<\/strong> to protect farmers, secure investor confidence, and ensure sustainable growth in the coffee and tea sectors.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2. Legal and Constitutional Basis<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 43(1)(c), Constitution of Kenya (2010):<\/strong> Every person has the right to be free from hunger and to have adequate food of acceptable quality. Agricultural income is central to this right.<\/li>\n\n\n\n<li><strong>Article 46:<\/strong> Consumers have the right to goods and services of reasonable quality, including fair agricultural trade practices.<\/li>\n\n\n\n<li><strong>Article 232:<\/strong> Calls for accountability and transparency in the use of public resources.<\/li>\n\n\n\n<li><strong>Agriculture and Food Authority Act (2013):<\/strong> Mandates the regulation, development, and promotion of scheduled crops including coffee and tea.<\/li>\n\n\n\n<li><strong>Public Finance Management Act (2012):<\/strong> Provides for prudent use and accountability of cooperative and trade funds.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3. Key Challenges in the Coffee and Tea Sectors<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Price Manipulation<\/strong> \u2013 Farmers receive disproportionately low payments compared to global market prices.<\/li>\n\n\n\n<li><strong>Cartels and Rogue Middlemen<\/strong> \u2013 Exploitative brokers undermine farmers\u2019 earnings and control the supply chain.<\/li>\n\n\n\n<li><strong>Delayed Payments<\/strong> \u2013 Farmers often wait unreasonably long to access proceeds from their crops.<\/li>\n\n\n\n<li><strong>Weak Cooperative Governance<\/strong> \u2013 Mismanagement and corruption in SACCOs and cooperative societies erode farmer confidence.<\/li>\n\n\n\n<li><strong>Restricted Market Access<\/strong> \u2013 Farmers and cooperatives are excluded from direct international trade.<\/li>\n\n\n\n<li><strong>Sustainability Risks<\/strong> \u2013 Unsustainable practices and climate change threaten long-term productivity and competitiveness.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4. Policy and Legal Recommendations<\/h2>\n\n\n\n<p>KAI proposes the following interventions:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Legal Safeguards for Farmers<\/strong>\n<ul class=\"wp-block-list\">\n<li>Enforce mandatory <strong>minimum guaranteed prices<\/strong> for coffee and tea.<\/li>\n\n\n\n<li>Strengthen <strong>legal recourse mechanisms<\/strong> for farmers in cases of exploitation or fraud.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Transparency and Accountability<\/strong>\n<ul class=\"wp-block-list\">\n<li>Establish <strong>digital traceability systems<\/strong> for pricing, sales, and payments.<\/li>\n\n\n\n<li>Strengthen the <strong>regulatory oversight role of the Agriculture and Food Authority (AFA)<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Market Access Reforms<\/strong>\n<ul class=\"wp-block-list\">\n<li>Legally empower cooperatives and farmer groups to engage in <strong>direct sales to local and international buyers<\/strong>.<\/li>\n\n\n\n<li>Promote Kenya\u2019s alignment with <strong>fair-trade certification standards<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Cooperative Governance<\/strong>\n<ul class=\"wp-block-list\">\n<li>Introduce mandatory <strong>annual independent audits<\/strong> of cooperatives.<\/li>\n\n\n\n<li>Criminalize and penalize <strong>embezzlement of farmers\u2019 proceeds<\/strong> by cooperative officials.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Investor and Trade Protection<\/strong>\n<ul class=\"wp-block-list\">\n<li>Create a <strong>farmer\u2013investor dispute resolution mechanism<\/strong> under the Ministry of Agriculture.<\/li>\n\n\n\n<li>Enhance <strong>contract enforcement<\/strong> for local and foreign investors in the sector.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Sustainability and Climate Adaptation<\/strong>\n<ul class=\"wp-block-list\">\n<li>Promote <strong>climate-smart agricultural practices<\/strong> to safeguard long-term productivity.<\/li>\n\n\n\n<li>Support access to financing for sustainable farming methods through public\u2013private partnerships.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5. Conclusion<\/h2>\n\n\n\n<p>The survival of Kenya\u2019s coffee and tea industries depends on <strong>restoring trust, ensuring fair trade, and protecting both farmers and investors<\/strong>.
